Kimochi — Terms of Use

1) Overview
These Terms govern your access to and use of the Kimochi application (“the App”).
By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2) Eligibility and acceptable use

Age requirement
You must be at least 13 years old and comply with all applicable local laws to use the App.

Personal use only
The App is intended for personal, non-commercial use only.

Prohibited activities
You may not:

use the App for any unlawful purpose,

attempt to reverse engineer, decompile, or tamper with the App,
-
interfere with the App’s security or operation,
-
infringe the rights of third parties,
-
attempt to access another user’s iCloud account or private data.

3) Well-being tool, not medical advice
Kimochi is designed to support personal reflection and emotional well-being.
It is not a medical device and does not provide medical advice, diagnosis, treatment, or cure for any condition.
If you are experiencing distress or believe you need professional support, please seek advice from a qualified healthcare professional.
4) Your content
All entries and content you create in the App belong to you.
Your data is stored locally on your device and/or in your personal iCloud account if synchronization is enabled.
We do not access, review, moderate, or store your private journal content.
5) In-app purchases and subscriptions
Some features of the App may require payment, either as a one-time purchase or a subscription.
All payments are processed through your Apple ID and managed by Apple.

Automatic renewal
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

Deleting the App does not cancel an active subscription.

You can manage or cancel subscriptions in Settings > [your name] > Subscriptions on your Apple device.
Apple’s terms and policies govern billing and refunds.
6) Intellectual property
The App, including its software, design, content, and brand assets, is owned by Nicolas Kalogeropoulos.
You are granted a limited, personal, non-transferable, and revocable license to use the App in accordance with these Terms.
7) Third-party services
The App may rely on third-party services, including Apple iCloud for data synchronization and TelemetryDeck for privacy-focused analytics.
The use of these services is subject to their respective terms of service and privacy policies.
8) Disclaimer of warranties
The App is provided “as is” and “as available”, without warranties of any kind, express or implied.
We do not guarantee that the App will be uninterrupted, error-free, or meet your specific expectations.
9) Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising out of or related to your use of the App.
10) Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your misuse of the App or your violation of these Terms.
11) Termination
We reserve the right to suspend or terminate your access to the App in the event of serious or repeated violations of these Terms.
You may stop using the App at any time and manage or cancel subscriptions through your Apple account settings.
12) Governing law and jurisdiction
These Terms are governed by the laws of France.
The courts of Paris shall have exclusive jurisdiction, subject to any mandatory consumer protection laws that cannot be waived.
13) Changes to the Terms
We may update these Terms from time to time.
The current version will always be available within the App and/or on getkimochi.app.
Material changes will be communicated to you within the App.

Les présentes Conditions régissent votre utilisation de l’application Kimochi.
Si vous n’y consentez pas, vous ne devez pas utiliser l’Application.
2) Éligibilité et usage acceptable

Âge : Vous devez avoir au moins 13 ans (et respecter les lois locales applicables).

Usage personnel : L’Application est destinée à un usage personnel et non commercial.

Interdictions : Toute utilisation illégale, l’ingénierie inverse, toute tentative d’atteinte à la sécurité de l’Application, la violation des droits de tiers, ou toute tentative d’accès aux données iCloud ou privées d’un autre utilisateur est strictement interdite.
3) Outil de bien-être, pas un avis médical
Kimochi soutient la réflexion personnelle et le bien-être émotionnel.
Ce n’est pas un dispositif médical et l’Application ne permet pas de diagnostiquer, traiter ou guérir une quelconque pathologie.
En cas de besoin, consultez un professionnel de santé qualifié.
4) Vos contenus
Les entrées que vous créez vous appartiennent.
Elles sont stockées sur votre appareil et/ou dans votre iCloud personnel si vous activez la synchronisation.
Nous n’avons jamais accès à votre journal privé et ne le modérons pas.
5) Achats intégrés et abonnements
Certaines fonctionnalités peuvent être payantes (achat unique ou abonnement).
Les paiements sont traités via votre identifiant Apple.

Renouvellement automatique : pour éviter le renouvellement, vous devez annuler au moins 24 heures avant la fin de la période en cours.

La suppression de l’Application n’entraîne pas l’annulation d’un abonnement.

Les abonnements peuvent être gérés dans Réglages > [votre nom] > Abonnements.
(Les règles applicables sont définies par Apple.)
6) Propriété intellectuelle
L’Application, son code et ses éléments de marque sont la propriété de Nicolas Kalogeropoulos.
Ils vous sont concédés sous licence pour un usage personnel, non transférable et révocable.
7) Services tiers
L’Application peut s’appuyer sur des services tiers, notamment Apple iCloud et des outils d’analytique (TelemetryDeck).
Leurs propres conditions d’utilisation et politiques de confidentialité s’appliquent à ces services.
8) Exclusion de garantie
L’Application est fournie « en l’état » et « selon disponibilité », sans garantie d’aucune sorte.
Nous ne garantissons pas un fonctionnement ininterrompu ni exempt d’erreurs.
9) Limitation de responsabilité
Dans les limites autorisées par la loi, nous ne saurions être tenus responsables des dommages indirects, accessoires, spéciaux, consécutifs ou punitifs (y compris la perte de données) résultant de l’utilisation de l’Application.
10) Indemnisation
Vous acceptez de nous indemniser et de nous tenir indemnes de toute réclamation résultant d’une mauvaise utilisation de l’Application ou d’une violation des présentes Conditions.
11) Résiliation
Nous pouvons suspendre ou résilier votre accès en cas de violation grave ou répétée des présentes Conditions.
Vous pouvez cesser d’utiliser l’Application à tout moment et gérer vos abonnements via les réglages Apple.
12) Droit applicable et juridiction compétente
Les présentes Conditions sont régies par le droit français.
Les tribunaux de Paris sont compétents, sous réserve des règles impératives de protection des consommateurs.
13) Modifications des Conditions
Nous pouvons mettre à jour ces Conditions.
La version en vigueur est disponible dans l’Application et/ou sur getkimochi.app.
Toute modification substantielle fera l’objet d’une notification dans l’Application.
